These Terms and Conditions (“Terms”) govern your access to and use of the services, website, and related products (the “Services”) provided by AirFlow AI LLC (“Company”, “we”, “us”, or “our”), an AI-powered marketing agency specializing in helping HVAC businesses scale revenue through paid social media campaigns on Facebook and Instagram, and AI voice caller agents for inbound/outbound calls and automated appointment booking, all delivered via GoHighLevel CRM with client sub-accounts. We may modify these Terms at any time, updating the “Effective Date” and notifying users as appropriate. Continued use of the Services constitutes acceptance of the revised Terms.
1. Use of Services
You agree to use our Services only for lawful purposes and in accordance with these Terms. You must be at least 18 years old or the age of majority in your jurisdiction to use our Services.
2. Accounts and Registration
To access certain features, you may be required to register for an account. You agree to provide accurate and complete information and to keep your account secure. You are responsible for all activities that occur under your account.
3. SMS Marketing Program
As part of our Services, we may offer SMS (text messaging) programs through your GoHighLevel sub-account to enhance outreach for HVAC businesses. These programs are opt-in only, compliant with the Telephone Consumer Protection Act (TCPA) and CTFCAA, and require explicit user consent.
Messaging Use Cases
Appointment Booking and Reminders: Automated texts for confirmations, rescheduling, or follow-ups (e.g., “Your HVAC tune-up is set for tomorrow at 2 PM. Reply YES to confirm.”).
Lead Nurturing: Follow-up texts to qualify prospects (e.g., “Thanks for inquiring about AC repair! What’s your availability?”).
Promotional Campaigns: Targeted offers tied to social ads (e.g., “20% off emergency HVAC repairs—claim now!”).
Opt-Out Instructions
You (or your end-users) can opt out of SMS messages at any time:
Reply “STOP” to any SMS from our system.
For voice calls, say “STOP” or request removal during the interaction.
Email [email protected] with your phone number and opt-out request.
You’ll receive a confirmation text (e.g., “You have been unsubscribed. Reply HELP for assistance.”). We honor opt-outs immediately and cease promotional messages. Standard message and data rates may apply for opt-out replies.
Disclosures
Message and Data Rates: You acknowledge that standard message and data rates may apply from your mobile carrier for sending or receiving SMS. AirFlow AI is not responsible for these charges.
Carrier Liability Disclaimer: AirFlow AI is not liable for delays, failures, or issues in message delivery due to carrier problems, network outages, or third-party services. We use reputable SMS providers via GoHighLevel, but delivery is not guaranteed.
Frequency: Message frequency varies by campaign (e.g., 1-4 messages/month for reminders). Estimates are provided upfront.

4. Payment Terms
If you purchase any Services, you agree to pay all applicable fees and taxes. Payments are processed via secure third-party payment providers. All purchases are final unless otherwise stated in your service agreement. Late payments may incur a 1.5% fee.
5. Intellectual Property
All content, code, logos, branding, and materials on our website and within our Services, including AI tools and templates, are the exclusive property of AirFlow AI LLC or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive license to use deliverables for your HVAC business only. You may not copy, modify, distribute, create derivative works, or reverse-engineer our AI agents without our prior written consent.
6. User Conduct
You agree not to:
Use our Services for any fraudulent, abusive, or illegal activity.
Interfere with or disrupt our systems, networks, or servers.
Upload viruses or malicious code.
Reverse engineer or gain unauthorized access to our systems.
7. Termination
We reserve the right to suspend or terminate your access to the Services at any time, without notice or liability, if you violate these Terms or engage in conduct we deem harmful to our business or users. Upon termination, your GoHighLevel sub-account will be archived.
8. Disclaimers
Our Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Services will be error-free, secure, or uninterrupted.
9. Limitation of Liability
To the fullest extent permitted by law, AirFlow AI LLC will not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising out of or related to your use of the Services. Our total liability shall not exceed fees paid in the prior 3 months.
10. Indemnification
You agree to indemnify and hold harmless AirFlow AI LLC, its affiliates, officers, agents, and employees from any claim, demand, or damages arising from your use of the Services or violation of these Terms.
